TERMS AND CONDITIONS OF THE AUTOMECHANIKA SURVEY PROMOTIONAL CAMPAIGN

§ 1. GENERAL PROVISIONS

  1. The organiser of the promotional campaign entitled “Automechanika Survey” (hereinafter: “the Campaign”) is AUTO PARTNER SPÓŁKA AKCYJNA, with its registered office in Bieruń, ul. Ekonomiczna 20, 43-150 Bieruń, entered in the Register of Entrepreneurs maintained by the Katowice-Wschód District Court in Katowice, 8th Commercial Division of the National Court Register, under KRS number 0000291327, NIP 6340011017, REGON 276249079 (hereinafter: “the Organiser”).
  2. The campaign is being run during the Frankfurt Motor Show at the Organiser’s stand (hereinafter: “the Show”).
  3. The aim of the Campaign is to gather the views of fair visitors on the Organiser’s offering and activities, as well as to explore opportunities for collaboration, by completing the Questionnaire available at
  4. Participation in the Campaign is voluntary and free of charge.
  5. By completing the Survey, the Participant confirms that they have read the Terms and Conditions and accept its provisions, and that they have also read the Information Notice.
  6. The Information Notice sets out the rules for the processing of personal data in connection with the completion of the Survey on the day of the Fair. The information clause in question constitutes Appendix 1 to the Terms and Conditions. Further information on the rules governing the processing of personal data is set out in the website’s Privacy Policy.
  7. The promotional campaign is not a ‘game of chance’, including in particular a ‘cash lottery’, a ‘promotional lottery’ or a ‘raffle’, the outcome of which depends on chance (the conduct of a draw) within the meaning of Article 2 of the Act of 19 November 2009 on Gambling (Journal of Laws 09.201.1540).

§ 2. DEFINITIONS

For the purposes of these Terms and Conditions, the following definitions are specified:

  1. Terms and Conditions – means this document containing the set of rules and conditions for participation in the Automechanika Survey Promotional Campaign, available at the venue of the Fair,
  2. Organiser – means AUTO PARTNER SPÓŁKA AKCYJNA with its registered office in Bieruń, 20 Ekonomiczna Street, 43-150 Bieruń, entered in the Register of Entrepreneurs maintained by the Katowice-Wschód District Court in Katowice, 8th Commercial Division of the National Court Register, under KRS number 0000291327, NIP 6340011017, REGON 276249079.
  3. The Fair – means the presentation of Auto Partner S.A.’s sales offering, taking place in Frankfurt am Main from 8 to 12 September 2026.
  4. Participant – means an entrepreneur carrying on a business or a natural person representing an entrepreneur or a company (including, amongst others, an employee or associate of the entrepreneur/company), who is aged 18 or over and who visited the Organiser’s stand during the Trade Fair (hereinafter referred to as the “Participant”).
  5. Questionnaire – an electronic or paper form prepared by the Organiser, the completion of which is a condition of participation in the Promotional Campaign. As part of the Questionnaire, the Participant may voluntarily provide their opinions and – at their own discretion – the personal data necessary to participate in the Campaign and receive the Prize.

§3. CONDITIONS OF PARTICIPATION

  1. Participants in the Automechanika Survey Promotional Campaign are required to familiarise themselves with the content of these Terms and Conditions and the information notice.
  2. Participation in the Automechanika Survey Promotional Campaign is free of charge and voluntary.
  3. A Participant may take part in the Campaign only once.

§ 4. RULES OF PARTICIPATION

  1. Participants visiting the Organiser’s stand during the Fair may voluntarily complete the Survey.
  2. Providing personal data such as first name, surname, company name, email address or telephone number in the Questionnaire is voluntary, but necessary for participation in the prize draw, to determine eligibility to receive a prize and for the prize to be awarded.
  3. Every tenth correctly completed Survey containing the Participant’s first name, surname, company name, email address or telephone number entitles the Participant to receive a gift.
  4. The gift is a power bank bearing the Auto Partner logo, with a value of 99 zlotys gross.
  5. The gift cannot be exchanged for a cash equivalent or for any other item.
  6. The Organiser will present the gift to the Participant during the Fair, and if this is not possible, will post it to the address provided by the Participant within 30 days of the end of the Fair.
  7. The promotional campaign is international in nature and is aimed at adults visiting the Organiser’s stand, regardless of their nationality, place of residence or country of origin.
  8. The Organiser hereby informs that the gifts provided as part of the Campaign are of a promotional and advertising nature, with values as specified in paragraph 4 above. The Participant bears sole responsibility for determining and fulfilling any tax obligations or other public-law obligations associated with receiving a gift, if such obligations arise from the legal provisions applicable in the country in which the entrepreneur/company carries out its business activities.
  9. Where mandatory legal provisions require the Organiser to fulfil specific obligations relating to the provision of the gift, the Participant undertakes to provide the Organiser with the necessary information and documents required by those provisions.
  10. The Organiser reserves the right to refuse to issue a gift if the Participant provides false information or breaches the provisions of these Terms and Conditions.
  11. Individuals who do not provide the personal data required to take part in the prize allocation process will not be eligible to receive a prize, as the Organiser will be unable to verify their entitlement to the prize, identify the eligible person or document the prize’s handover.
  12. For security reasons, the Organiser may refuse to allow persons to complete the Questionnaire if they:
    1. are under the influence of alcohol, intoxicating substances or other substances with similar effects,
    2. pose a threat to fair participants, including those in possession of weapons or other dangerous objects, behaving aggressively, provocatively or in any other way threatening the safety or order of the Fair.
  13. The Organiser reserves the right to exclude from participation in the Event any person who fails to comply with the provisions of these regulations, the law and safety rules.

§ 5. RULES GOVERNING THE USE OF IMAGE, VOICE AND STATEMENTS

  1. The Organiser may record the course of participation in the Fair, including the image of Participants as part of a wider scene, such as a gathering, landscape or public event, in accordance with Article 81(2)(2) of the Act of 4 February 1994 on Copyright and Related Rights. If a Participant’s image is not recorded in this manner, paragraph 2 below shall apply to its use.
  2. Presence at the Fair venue requires consent to the free-of-charge use of the Participant’s image for the purposes of reporting on the Fair, in accordance with Article 81(1) of the Act of 4 February 1994 on Copyright and Related Rights, and to the processing of personal data in the form of the image. The consent forms are set out in Annexes 2 and 3 to these Regulations.

§6. FINAL PROVISIONS

  1. The Terms and Conditions are available at the Organiser’s stand throughout the duration of the Event and on the website https://automechanika.autopartner.com/.
  2. The Organiser reserves the right to amend the Terms and Conditions only for valid reasons, provided that such amendments do not infringe upon the Participants’ acquired rights.
  3. In matters not covered by these Terms and Conditions, the provisions of Polish law and the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) shall apply.
  4. Should any provision of these Terms and Conditions be amended or declared invalid by a final court ruling, the remaining provisions shall remain in force.
  5. Any disputes between the Organiser and the Supplier or a Participant shall first be settled amicably and, subsequently, by the court having jurisdiction over the Organiser’s registered office.

Appendix 1

INFORMATION NOTICE REGARDING THE PROCESSING OF PERSONAL DATA IN CONNECTION WITH PARTICIPATION IN THE ‘AUTOMECHANIKA SURVEY’ PROMOTIONAL CAMPAIGN, COMPLETING THE SURVEY, RECEIVING A GIFT AND THE USE OF THE PARTICIPANT’S IMAGE

  1. DEFINITIONS
    1.1. Data Controller – AUTO PARTNER SPÓŁKA AKCYJNA with its registered office in Bieruń, ul. Ekonomiczna 20, 43-150, Bieruń, entered in the Register of Entrepreneurs maintained by the Katowice-Wschód District Court in Katowice, 8th Commercial Division of the National Court Register, under KRS number 0000291327, NIP 634 001 10 17, REGON 276249079.
    1.2. Personal data – information relating to an identified or identifiable natural person on the basis of one or more specific factors determining their physical, physiological, genetic, mental, economic, cultural or social identity, including their image, voice recording, contact details, location data, information contained in correspondence, and information collected via recording equipment or other similar technology.
    1.3. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
    1.4. Data subject – a natural person to whom the personal data processed by the Controller relates, e.g. a person creating an account or making a purchase.
  2. CONTACTING THE CONTROLLER

  3. PURPOSES AND LEGAL BASES FOR PROCESSING
    3.1. Personal data is processed:
    3.1.1. for the purposes of organising and conducting the Campaign, receiving and analysing the Questionnaire, gauging interest in the Controller’s offer, determining the Participant’s eligibility to receive a gift, issuing the gift and documenting the course of the Campaign – pursuant to Article 6(1)(f) of the GDPR, i.e. the Controller’s legitimate interest in conducting promotional activities, surveying the opinions of trade fair participants, assessing interest in the offer, organising the Campaign, issuing gifts and building business relationships;
    3.1.2. for the purpose of contacting the Participant in connection with their participation in the Campaign, completion of the Questionnaire, the provision of a gift, or the possibility of establishing cooperation – pursuant to Article 6(1)(f) of the GDPR, i.e. the Controller’s legitimate interest in organising the Campaign, communicating with persons interested in the offer and developing business relationships;
    3.1.3. for the purpose of producing photographic, audio and video material in connection with the Participant’s attendance at the trade fair and processing such material, including its modification, supplementation, adaptation, editing or retouching – pursuant to Article 6(1)(f) of the GDPR, i.e. the Controller’s legitimate interest in documenting the Controller’s participation in the trade fair and conducting information activities, provided that the Participant’s image constitutes only a detail of the whole, such as a gathering, landscape or public event;
    3.1.4. for the purpose of using and disseminating the Participant’s individual image in advertising, promotional, marketing or informational materials – solely where separate consent has been given for the dissemination of the image, pursuant to Article 6(1)(a) of the GDPR and Article 81(1) of the Act on Copyright and Related Rights.
    3.1.5. for the purpose of pursuing, establishing or defending against any potential claims relating to participation in the Campaign, completion of the Questionnaire, the issue of a gift or the use of an image – pursuant to Article 6(1)(f) of the GDPR, i.e. the Controller’s legitimate interest in protecting its rights.
  4. DATA RECIPIENTS
    4.1. Personal data will be disclosed to external entities, including, in particular, visitors to websites within the Controller’s domain and recipients of promotional, marketing and similar campaigns in which the image will be used.
    4.2. Personal data may be made available to entities cooperating in the production of photographic, audio and video materials, including entities with access to the image and works in which your image will be included.
    4.3. Personal data will be made available to employees and associates of Auto Partner S.A. authorised to process personal data.
  5. PERIOD OF PROCESSING OF PERSONAL DATA
    5.1. Personal data processed on the basis of the Controller’s legitimate interest will be processed for the period necessary to organise and carry out the Campaign, receive and analyse the Questionnaire, issue the gift, document the course of the Campaign and handle any communication with the Participant, unless the Participant lodges a valid objection to the processing of their data.
    5.2. The data processing period may be extended if processing is necessary to establish, pursue or defend against any potential claims; following the expiry of this period, the data will be deleted or anonymised.
    5.3. Personal data processed on the basis of consent, in particular data relating to the individual use and dissemination of an image, will be processed until such time as consent is withdrawn; however, the withdrawal of consent does not affect the lawfulness of processing carried out prior to its withdrawal.
    5.4. Personal data is retained for the period necessary to fulfil all obligations and carry out all activities related to the production and use of recordings, with the exception of data concerning incidents involving breaches of data protection rules, the safety of persons or property, internal company regulations, or statutory provisions. Such data may be processed for a longer period – i.e. until the matter has been clarified or the relevant proceedings have been concluded.
  6. INFORMATION ON AUTOMATED DECISION-MAKING, INCLUDING PROFILING
    6.1. Personal data will not be subject to automated decision-making processes by the Controller, including profiling.
  7. RIGHTS RELATED TO THE PROCESSING OF PERSONAL DATA RIGHTS OF DATA SUBJECTS
    7.1. Data subjects have the following rights:
    7.1.1. the right to information regarding the processing of personal data – on this basis, the Controller provides the individual making the request with information about the processing of data, including, in particular, the purposes and legal grounds for processing, the scope of the data held, the entities to whom it is disclosed, and the planned date of data erasure;
    7.1.2. the right to obtain a copy of the data – on this basis, the Controller shall provide a copy of the data being processed concerning the individual making the request. The Controller will not comply with such a request if doing so could adversely affect the rights and freedoms of others;
    7.1.3. the right to erasure – on this basis, a request may be made for the erasure of data where processing is no longer necessary for any of the purposes for which it was collected;
    7.1.4. right to restriction of processing – should such a request be made, the Controller shall cease carrying out operations on Personal Data – with the exception of operations to which the Data Subject has consented – and from storing it, in accordance with the adopted retention rules or until the grounds for restricting data processing cease to exist (e.g. a decision is issued by a supervisory authority authorising further processing of the data). The exercise of this right is not possible to the extent that it would breach the duty of confidentiality arising from specific provisions;
    7.1.5. the right to object to other purposes of data processing – The data subject may, at any time, object – on grounds relating to their particular situation – to the processing of Personal Data carried out on the basis of the Controller’s legitimate interest; such an objection must be accompanied by a statement of reasons;
    7.1.6. Right to lodge a complaint – where the Data Subject considers that the processing of Personal Data infringes the provisions of the GDPR or other data protection legislation, they may lodge a complaint with the supervisory authority responsible for the processing of Personal Data, which has jurisdiction over the Data Subject’s habitual residence, their place of work or the place where the alleged infringement occurred. In Poland, the supervisory authority is the President of the Office for Personal Data Protection.
    SUBMITTING REQUESTS RELATING TO THE EXERCISE OF RIGHTS
    7.2. Requests concerning the exercise of Data Subjects’ rights may be submitted:
    7.2.1. in writing to the following address: AUTO PARTNER S.A. ul. Ekonomiczna 20, 43-150, Bieruń, marked ‘Personal data’;
    7.2.2. by email to: dpo@autopartner.com
    7.3. If the Controller is unable to identify the individual on the basis of the request submitted, it will ask the applicant for further information. Providing such data is not mandatory, but failure to do so will result in the request being refused.
    7.4. A response to the request should be provided within one month of its receipt. Should it be necessary to extend this deadline, the Controller shall inform the applicant of the reasons for doing so.
    7.5. Where a request has been submitted to the Controller electronically, a response shall be provided in the same form, unless the applicant has requested a response in a different form. In other cases, the reply shall be provided in writing. Where the timeframe for processing the request makes it impossible to provide a reply in writing, and the scope of the data concerning the applicant processed by the Controller allows for contact by electronic means, the reply shall be provided electronically.
    7.6. The Controller retains information concerning the request submitted and the person who submitted it, in order to ensure the ability to demonstrate compliance and to establish, defend against or pursue any claims by data subjects. The register of requests is stored in a manner that ensures the integrity and confidentiality of the data it contains.

I, the undersigned, pursuant to Article 81(1) of the Act on Copyright and Related Rights of 4 February 1994, hereby consent to the use and dissemination, free of charge, of my personal rights in the form of my first name, surname, voice and likeness, as well as the processing of personal data in the form of my likeness in accordance with the terms set out below.

  1. I declare that, at the time of granting this consent, I have no obligations towards any entities that would prevent or significantly impede the use of my likeness, and that I am fully entitled to dispose of it freely, and that the execution of this consent will not infringe any third-party rights; I accept full legal responsibility in respect of the above declaration.
  2. I consent to the use and dissemination, free of charge, of my likeness and my personal rights in the form of my first name, surname, voice and likeness, as well as the processing of personal data in the form of my likeness for advertising, promotional, marketing and informational purposes, and for the purpose of producing a report on the participation of Auto Partner S.A. or its representatives in the Event organised as part of the Fair, in connection with the business activities conducted by AUTO PARTNER S.A.
  3. I authorise the creation, without any time limit, of adaptations of materials, involving alterations, additions and modifications, including the editing and retouching of all or part of photographs or audio-visual materials in which my likeness appears, and the right to dispose of and use the resulting adaptations (exercise of derivative rights), including their publication, without any obligation to approve the final version.
  4. The consent referred to above covers the use of my likeness in any work and in other materials that do not constitute a work within the meaning of copyright law, in connection with my participation in the Event organised as part of the Fair.
  5. The right to use my likeness, covered by this consent, remains in force until such time as the consent is revoked. Withdrawal of consent has no effect on the use of the image that took place whilst consent was in force; in particular, it does not require the removal of materials added prior to the withdrawal of consent.
  6. The consent referred to above is unrestricted in every respect, including in terms of time and territory, and authorises repeated publication at any time and use in the following fields of exploitation:
    a. with regard to fixation and reproduction – the production of copies using a specified technique, including printing, reprography, magnetic recording and digital techniques;
    b. with regard to the distribution of the original or copies – placing the original or copies on the market, lending or hiring them out;
    c. in relation to distribution by means other than those specified in point 2 – public performance, exhibition, display, reproduction, broadcasting and rebroadcasting, as well as making a work publicly available in such a way that anyone may have access to it at a place and time of their choosing;
    d. in relation to the promotion of own brands through advertising and marketing, such as:
    • Advertising spots – online, including social media adverts;

    e. regarding the promotion of own brands through photography, via:

    f. specialising in promoting own brands via social media and online platforms, such as:
    • Instagram, Facebook, TikTok – photos, videos, live streams.
    • YouTube – videos, vlogs, adverts.

    g. for the promotion of own brands through education and training, such as:
    • Educational materials – photos, videos in textbooks and online courses.
    • Presentations and lectures – use of imagery in materials for training sessions, webinars and conferences.
    h. regarding the promotion of own brands through events and public gatherings, such as industry events – use of photographs or videos featuring event participants, e.g. trade fairs and conferences.
    i. Charitable activities related to the policy of Auto Partner S.A.
  7. The consents described in this statement are granted to Auto Partner S.A. and entities cooperating with it in connection with the production of Recordings.
  8. I hereby declare that I have read the information notice on the processing of personal data attached to this consent and, in accordance with Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), I hereby consent to the processing by AUTO PARTNER S.A. of my personal data for purposes relating to the use of my image by Auto Partner S.A. and in accordance with the information clause below.

I declare that, at the time of granting this consent, I have no obligations towards any entities that would prevent or significantly impede the use of the minor’s likeness, and that I have full parental authority over the minor/or am the minor’s legal guardian, and that the execution of this consent will not infringe upon any rights of the minor or of third parties. I accept full legal responsibility for the above declaration.
  2. I consent to the use and dissemination, free of charge, of the minor’s image and personal rights in the form of their first name, surname, voice and likeness, as well as to the processing of personal data in the form of the image for advertising, promotional, marketing and informational purposes, and for the purpose of producing a report on the participation of Auto Partner S.A. or its representatives in the Event organised as part of the Fair, in connection with the business activities conducted by AUTO PARTNER S.A.
  3. I authorise the creation of derivative works of the materials, without any time limit, involving alterations, additions and modifications, including the editing and retouching of all or part of photographs or audio-visual materials in which my child’s image appears, and the right to dispose of and use the resulting adaptations (exercising derivative rights), including their publication, without any obligation to approve the final version, provided that this does not infringe upon my child’s honour, dignity or good reputation.
  4. The consent referred to above covers the use of the minor’s image in any work and other materials not constituting a work within the meaning of copyright law, in connection with the minor’s participation in an Event organised as part of the Fair, in such a way that it does not infringe upon our child’s honour, dignity or good reputation.
  5. The right to use the image, covered by this consent, remains in force until such time as the consent is withdrawn. Withdrawal of consent has no effect on the use of the image that took place whilst the consent was in force; in particular, it does not necessitate the removal of materials added prior to the withdrawal of consent.

  7. The consent described in this statement is granted to Auto Partner S.A. and entities cooperating with it in connection with the production of the Recordings.
